1. Acceptance of Terms

By accessing roadshieldsolutions.com (the "Site"), browsing its content, submitting a contact inquiry, or initiating a rental booking request, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy, which is incorporated herein by reference.

If you are accessing the Site or submitting an inquiry on behalf of a company, organization, or other legal entity, you represent and warrant that you have authority to bind that entity to these Terms, and the term "you" shall refer to both you individually and that entity.

2. Description of Services

Road Shield Solutions provides nationwide rental of Truck-Mounted Attenuator (TMA) crash trucks and related equipment for use in highway and roadway work zones. Our fleet includes MASH-certified TMA units designed to protect road workers in accordance with applicable federal and state safety standards.

The Site serves as an informational and inquiry platform. Submission of a contact form or rental booking request through the Site constitutes an inquiry only and does not create a binding rental contract. All rental agreements are subject to: (a) fleet availability at the time of confirmation; (b) geographic service coverage; (c) execution of a separate, written Rental Agreement; and (d) approval of the rental application at our sole discretion.

3. Eligibility

You must be at least 18 years of age to use this Site or submit any inquiry or booking request. By using the Site, you represent and warrant that you meet this requirement.

Our rental services are available to legally recognized business entities, government agencies, and licensed contractors. We reserve the right to decline any rental request without cause.

4. Permitted Use of the Site

You may use the Site solely for lawful purposes and in accordance with these Terms. Permitted uses include:

• Browsing information about our fleet, services, safety certifications, and coverage areas
• Submitting a contact inquiry or quote request
• Initiating a rental booking request through our booking portal
• Accessing and downloading publicly available documents such as compliance information

5. Prohibited Conduct

You agree not to use the Site in any of the following ways:

• In any manner that violates any applicable federal, state, local, or international law or regulation
• To submit false, misleading, or fraudulent information in any form
• To impersonate any person or entity, or falsely represent your affiliation with any person or entity
• To attempt to gain unauthorized access to any portion of the Site, its servers, or any systems connected to the Site
• To engage in any automated data collection such as scraping, crawling, or harvesting content or user information without our express written permission
• To transmit any unsolicited or unauthorized advertising or promotional material
• To interfere with or disrupt the integrity or performance of the Site or the data contained therein
• To introduce viruses, malware, or any other code designed to interrupt, destroy, or limit the functionality of any computer software, hardware, or telecommunications equipment

You agree to provide accurate, current, and complete information when submitting any form on the Site, including your name, contact details, zip code, and rental requirements. Providing false or misleading information may result in denial of service and, where applicable, legal liability.

Road Shield Solutions makes reasonable efforts to ensure that information published on the Site is accurate and current. However, we make no representation or warranty of any kind, express or implied, that the Site or its content is accurate, complete, reliable, or up to date. Pricing, availability, and service coverage information are subject to change without notice.

7. Intellectual Property

The Site and all of its content - including but not limited to text, graphics, photographs, logos, trademarks, service marks, icons, page layouts, and software - are the exclusive property of Road Shield Solutions or its licensors and are protected by applicable United States and international copyright, trademark, trade dress, and other intellectual property laws.

Nothing on the Site grants you any license or right to use any trademark, service mark, logo, or trade name of Road Shield Solutions without our prior written consent. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except as incidental to normal web browsing or as expressly permitted in writing by Road Shield Solutions.

8. Disclaimer of Warranties

THE SITE AND ALL INFORMATION, CONTENT, AND SERVICES PROVIDED THROUGH OR IN CONNECTION WITH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ROAD SHIELD SOLUTIONS EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO: (A) IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT; (B) WARRANTIES THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; AND (C) WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY INFORMATION ON THE SITE.

YOUR USE OF THE SITE IS SOLELY AT YOUR OWN RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ROAD SHIELD SOLUTIONS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF BUSINESS, OR LOSS OF GOODWILL ARISING OUT OF OR IN CONNECTION WITH: (A) YOUR USE OF OR INABILITY TO USE THE SITE; (B) ANY CONTENT OBTAINED FROM THE SITE; (C) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR SUBMISSIONS; OR (D) ANY OTHER MATTER RELATING TO THE SITE - EVEN IF ROAD SHIELD SOLUTIONS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN ALL CASES, ROAD SHIELD SOLUTIONS'S AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).

10. Indemnification

You agree to indemnify, defend, and hold harmless Road Shield Solutions and its officers, directors, employees, agents, contractors, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of or access to the Site; (b) your violation of these Terms; (c) your violation of any applicable law, regulation, or third-party right; or (d) any information you submit through the Site that is false, misleading, or infringes any third-party right.

11. Third-Party Links and Content

The Site may contain links to third-party websites, applications, or resources. These links are provided solely as a convenience to you. Road Shield Solutions does not endorse, and is not responsible or liable for, the content, privacy practices, products, or services of any linked third-party sites.

12. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of the State of Texas, without giving effect to any choice of law or conflict of law provisions.

Any legal action or proceeding arising out of or relating to these Terms, your use of the Site, or your submission of any inquiry or booking request shall be brought exclusively in the state or federal courts of competent jurisdiction located in Brazos County, Texas. You irrevocably consent to the personal jurisdiction and venue of such courts.

13. Dispute Resolution

Before filing any formal legal claim, you agree to first contact Road Shield Solutions at dispatch@roadshieldsolutions.com to describe the nature of the dispute and allow us a reasonable opportunity - not less than 30 days - to resolve the matter informally.

For disputes that cannot be resolved informally and involve claims of $10,000 or less, either party may elect to have the dispute resolved through binding arbitration under the American Arbitration Association's Consumer Arbitration Rules. This election is optional, and either party may decline and proceed in court.

14. Modifications to Terms

Road Shield Solutions reserves the right to revise and update these Terms at any time at our sole discretion. All changes are effective immediately when we post them on the Site. The "Last Updated" date at the top of this page will reflect when the most recent changes were made.

Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes.

15. Severability and Waiver

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms of Service, together with our Privacy Policy and, where applicable, our Rental Terms, constitute the sole and entire agreement between you and Road Shield Solutions with respect to the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site.
